§ 5-1-65. Service of complaints or orders; posting and filing.

  • Complaints or orders issued by the building official pursuant to this section shall be filed with the city clerk and with the Horry County Clerk of Court, together with a Lis Pendens describing the subject property and shall be served upon all persons having an interest in the property in the following manner:

    (1)

    By any person over the age of 18 years of age, including an agent of the city, by delivering a copy of the complaint or order to him personally or by leaving copies thereof at his dwelling house or usual place of abode with some person of suitable age and discretion then residing therein, or by delivering a copy to an agent authorized by appointment or by law to receive service;

    (2)

    By registered or certified mail, return receipt requested, and restricted delivery to the addressee. Service is effective upon the date of delivery as shown on the return receipt;

    (3)

    By written acceptance of the complaint or order by the interested party; or

    (4)

    If after due diligence the interested party cannot be found and that fact appears by affidavit filed with the city clerk, the service may be made by the publication of the complaint or order in any one (1) newspaper most likely to give notice to the person to be served not less than once a week for three (3) weeks. A copy of the complaint or order shall be forthwith deposited in the post office directed to the person to be served at his place of residence, unless it appears that such residence is neither known to the party making the application nor can, with reasonable diligence, be ascertained by him.

    A copy of such complaint or order shall also be posted in a conspicuous place on the premises affected by the complaint or order.
