Article A. Regulations and Requirements Relating to Smoking in Certain Public Places owned by the City of Conway, in City Vehicles and at Special Events on Public Property

§ 6-5-1. Findings and intent.

(a)

Findings. The Conway City Council does hereby find that:

(1)

The city is an incorporated municipality and, as such, possesses all powers granted to municipalities by the Constitution and the laws of the State of South Carolina, including the powers enumerated in SC Code Section 5-7-30 relating to regulating streets, markets, and public health; and

(2)

City council has determined that additional regulations beyond those in SC Code Section 44-95-10 et seq. (the "Clean Indoor Air Act of 1990") are appropriate in furtherance of its duty to protect the health of the general public; and

(b)

Intent. City council declares that the purpose of this ordinance is to preserve and improve the health, comfort, and environment of this city by limiting exposure to tobacco smoke.
