§ 7-4-82.3. Wrecker equipment requirements; inspection.

  • Application for participation in the rotation program will be considered upon the inspection and approval of each wrecker and upon issuance of a city business license. The owner shall apply for an inspection appointment and deliver the vehicle(s) and equipment to the location specified by the police chief or his designee. The police chief or his designee shall verify that the requirements listed below are met:

    (1)

    All wreckers shall have appropriate safety equipment, warning devices, flash lights and all other equipment necessary to protect the motoring public and be equipped with amber flashing lights visible in all directions for a distance of 500 feet in normal sunlight. Such equipment shall be maintained in good working order.

    (2)

    Each wrecker shall be equipped with a five (5) pound or larger fire extinguisher rated for class A, B and C fires. The extinguisher shall be permanently mounted on the wrecker to ensure easy access. The extinguisher must be annually certified and be fully charged or recharged as necessary.

    (3)

    Each wrecker shall display the owner or company name, address and telephone number in 2-inch high professional lettering on both sides of the vehicle. All lettering on wreckers shall be plainly visible and shall be in a color that contrasts to that of the wrecker. Temporary lettering, magnetic or otherwise is strictly prohibited.

    (4)

    Each wrecker will be equipped with a garbage can-type container, brooms, shovels, commercial absorbent and all other equipment necessary to perform a general clean-up of an accident area.

    Each wrecker service on the rotation list shall carry liability insurance on its wreckers and its premises in an amount not less than $300,000 for a light-duty conventional wrecker or rollback and $1,000,000 for a heavy-duty wrecker.

    (7)

    Each wrecker service on the rotation list shall carry insurance that covers vehicles, cargo, and other property in or on the vehicle during transit in an amount of not less than $75,000 for a light-duty conventional wrecker or rollback and $300,000 for a heavy-duty wrecker.

    (8)

    Each wrecker service on the rotation list shall carry garage keeper's liability insurance covering customers' vehicles in an amount not less than $100,000 for a light-duty conventional wrecker or rollback and $300,000 for a heavy-duty wrecker.

    (9)

    Each wrecker owned by any wrecker service on a rotation list shall be equipped with a towing log. The towing log shall be maintained by the wrecker service and shall accurately reflect all towing done by the wrecker service at the request of the Conway Police Department. The Conway Police Department shall design the wrecker log format. Each wrecker service owner shall be responsible for producing this towing log upon request by any peace officer.

    If a wrecker or any of its equipment fails to meet the inspection requirements of this section, the designated officer will disapprove the application for a city business license. In that event the company may make repairs as needed, resubmit its application and request a reinspection.

    Upon passing inspection, all wrecker companies located within the corporate city limits meeting the requirements of all city zoning, rules, regulations, and laws and upon issuance of a city business license may apply for inclusion on the department's rotation list.

    Each wrecker service shall be required to inspect its wrecker(s) and equipment periodically to ensure continuing compliance of this article. Wrecker(s) or equipment which does not pass inspection shall be taken out of operation by the wrecker service until such time as equipment requirements are met. The owner or operator shall immediately cause to be notified the police chief or his designee, when a wrecker is taken out of service due to defective equipment repairs. The owner or operator shall also notify the police chief or his designee when a wrecker is returned to service and is available for call.
