§ 3-3-14. Ownership.

  • (a)

    The rights of burial shall be used for no other purpose than burial of the human dead.

    (b)

    In the "old section," upon payment for interment rights, a certificate of interment shall be issued to the purchaser. This record, as well as records of interment, shall be kept as a permanent record in the city hall office. These office records shall be the only records recognized in determining burial rights. The city has no interest in interment certificates being recorded as a regular real estate deed in the court house. The city will not be responsible for the placing of documentary stamps on the interment certificate, if an owner of certificate decides he wants to have it recorded in the court house.

    (c)

    In the "new section," upon payment of the purchase price for the lot, a certificate of interment shall be issued to the purchaser. All lots in the "new section" shall be subject to the restrictions relating to Rose Hill Memorial Gardens.

    (d)

    No lot or interment right in a lot shall be assigned or issued by the city unless and until the fee therefor has been fully paid to the city.

    (e)

    No one shall be buried in any lot without owning interment rights therein, except by written consent of the owner of said lot or interment rights, or if he or she is the deceased, then the next of kin interested in such burial rights as determined by the city. Said written consent shall be legally executed and filed with city hall.

    (f)

    In the Infant Memorial Garden, upon payment of the purchase price for the lot, a certificate of interment shall be issued to the purchaser. This section shall be for the interment of infants only, age two (2) years or under. Plot sizes in this section will be four (4) feet by eight (8) feet. Plot size and the two-year age limitation shall not change for infant cremains. The fee for certificate of interment in this section of the cemetery will be $225 with $25 of the fee being deposited into the city's restricted fund for Rose Hill Memorial Gardens. All other restrictions relating to Rose Hill Memorial Gardens shall apply to the Infant Memorial Garden section.
